“SHELL V-POWER CLUB- WIN WEEKLY COLES EXPRESS GIFT CARDS AND TWO TICKETS TO THE FERRARI PADDOCK CLUB" PROMOTION

TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents aged 18 years or over who are new or existing members of the online Shell V-Power Club and who are able to travel to Melbourne, VIC, between 17/03/2012 and 19/03/2012 (“Eligible Entrants”). Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Employees of the Promoter include employment agency employees who are currently performing work for the Promoter.
  3. Individuals can join the online Shell V-Power Club, by visiting www.shellvpowerclub.com.au, following the prompts to the registration page, inputting the requested details including their full name, residential address, and email address and submitting the fully completed registration form.
  4. Promotion commences on 12/01/2012 and ends at 11:59pm AEDST on 15/02/2012 (“Promotional Period”).
  5. To be eligible to enter, Eligible Entrants must, during the Promotional Period, purchase any amount of either:
    • Shell V-Power petrol (subject to availability) from any participating Coles Express site in NSW, VIC, QLD, WA, ACT or SA; or
    • Shell Unleaded 95 or Shell Premium Unleaded (subject to availability) from any participating Coles Express site in TAS, NT or WA.
  6. Entry is not available for Shell Card, Fleet Card, Motorcharge or Motorpass purchases. It is the Eligible Entrant’s responsibility to request a purchase reciept if one is not provided upon purchase of the product.

  7. To enter, Eligible Entrants must then, during the Promotional Period visit www.shellvpowerclub.com.au, follow the prompts to the promotion entry page, input the requested details including their full receipt number and full URN code (found on the purchase receipt) and submit their fully completed online entry form.
  8. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  9. Incomplete or indecipherable entries will be deemed invalid.
  10. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with entry requirements.
  11. Eligible Entrants must retain their Coles Express service station purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an Eligible Entrant’s entries and forfeiture of any right to a prize.
  12. There will be one (1) draw conducted for each week of the Promotional Period (5 draws in total) and one (1) major prize draw. Entries open at 00:00 AEDST for each draw on the dates listed in the table below. Entries for each draw close at 11:59pm AEDST on the dates listed in the table below. All draws will take place at Anisimoff Legal, Suite 3, Erina Plaza 210 Central Coast Highway, Erina NSW 2252 at 12:00 (midday) AEDST (except in the case of the major prize draw which will take place at 12:30pm AEDST) on the dates listed in the table below. Un-drawn entries in each weekly draw will be entered into any subsequent weekly draws and all entries (including winners in a weekly draw) will be entered into the major prize draw. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

  13. Winners will be notified by in writing within two (2) business days of being drawn and their names will be published at www.shellvpowerclub.com.au on the dates listed in the table above. Any VIC or SA winners will also have their names published in The Australian on 01/03/2012. The Promoter’s decision is final and no correspondence will be entered into.
  14. The first five (5) valid entries drawn in each weekly draw will each win a $500 Coles Express gift card.
  15. The balance of the Coles Express gift card can be checked online by visiting www.giftcards.com.au and entering the Coles Express gift card number and pin number found on the back of the card or by phoning 1300 304 990. The Coles Express gift card is valid for two (2) years from the date of activation.

    The Coles Express gift card may be used in conjunction with any valid 4c Fuel Discount Receipt and FlyBuys card used as payment at Coles Express. If the winner uses the Coles Express gift card to purchase more than the amount available on their Coles Express gift card, the winner can make up the full amount with another type of tender accepted at Coles Express stores.   16. The first valid entry drawn in the major prize draw will win the major prize of a prize package for two adults (2) to the 2012 Melbourne Grand Prix valued at up to $15,000 depending on point of departure, to be taken between 17/03/2012 and 19/03/2012. The major prize consists of:
    1. Return flexible economy class airfares for two (2) adults from winner's nearest Australian capital city to Melbourne, VIC (if necessary);
    2. All airline & airport taxes;
    3. Return private car airport/accommodation transfers (if necessary);
    4. Two (2) nights’ twin share 4* accommodation at The Swanston in Melbourne, VIC (or similar) including breakfast each morning;
    5. Tickets for two (2) the Ferrari Paddock Club at the Melbourne Grand Prix on Race Day, Sunday 18 March 2012 and;
    6. $250 spending money for the winner only.
  17. If the winner is from VIC, then the prize does not include airfares, airport/accommodation transfers, airline and airport taxes and the airfares, transfers, airline and airport taxes components of the prize are not redeemable for cash.
  18. Prize must be taken to coincide with the 2012 Melbourne Grand Prix event with flights departing on 17/03/2012 (if required) and is subject to booking and flight availability.
  19. Additional spending money, meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The winner and his/her companion are responsible for ensuring that they have valid travel documentation.
  20. Frequent flyer points will not form part of the prize. The winner may be required to present their credit card at time of accommodation check in.
  21. Itinerary to be determined by the Promoter in its absolute discretion.
  22. Prize is subject to the standard terms and conditions of individual prize and service providers.
  23. The winner and his/her companion/s must depart from and return to the same departure point and travel together.
  24. The Ferrari Paddock Club ticket prize is subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
  25. As a condition of accepting the major prize, the winner (and his/her companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
  26. Subject to the unclaimed prize draw clauses, if for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited and not be redeemable for cash.
  27. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  28. Total prize pool value is up to $27,500. Prizes are not transferable or exchangeable and cannot be taken as cash.
  29. A draw for the major prize if unclaimed may take place on 08/03/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winner, if any, will be notified in writing within two (2) business days of the draw. The winner’s name will be published online at www.shellvpowerclub.com.au on 09/03/2012. In the event of a VIC or SA winner, their names will also be published in The Australian on 12/03/2012.
  30. A draw for any unclaimed weekly prizes may take place on 16/05/2012 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by will be notified in writing within two (2) business days of the draw. The winners’ names will be published online at www.shellvpowerclub.com.au on 23/05/2012. In the event of a VIC or SA winners, their names will also be published in The Australian on 23/05/2012.
  31. Eligible Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period, without remuneration, for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  32. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud,the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Eligible Entrants; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  33. Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant invalid.
  34. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  35. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) if the Melbourne Grand Prix event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or Eligible Entrant; or (g) use of a prize. Where the law applies or implies guarantees or warranties which cannot be excluded, the Promoter's liability for breach of those guarantees or warranties is limited to re-supplying the prize (or paying for the costs thereof), where this is permitted by law.
  36. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities, and winners’ names may be published. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing, research, profiling and publicity purposes including sending electronic messages or telephoning the Eligible Entrant. Eligible Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter. Subject to this paragraph, all personal information collected from Eligible Entrants will be handled in accordance with the Shell Privacy Policy which can be accessed by visiting www.shell.com.au.
